Alternate DNA Sources

DNA is a component of virtually every cell in the human body and is constantly shed from a variety of sources, including skin cells and hair. Forensically identifiable DNA samples that have not been contaminated can be found on evidence that is decades old. Several factors can affect DNA stability, such as sunlight, moisture, bacteria, and mold. Consequently, not all DNA evidence samples submitted for evaluation will result in a usable DNA profile. You may be asked to submit additional samples for testing.

Paternity Testing in Colorado - Please check the laws in your home state!
This article is provided as a general commentary and should not be considered as legal advice

Colorado law allows for various types of evidence to establish paternity.  Evidence relating to paternity may include:

While there are many types of evidence that may be utilized to establish paternity, the most precise and definitive method available for determining parentage is through genetic (DNA) testing. Everyone is born with a unique genetic blueprint known as DNA (Deoxyribonucleic Acid.) Because DNA is passed down from mother and father to child, DNA Identification of genetic markers provides a conclusive way to determine biological relationships. By comparing the DNA profiles of the mother, father, and child, the genetic relatedness of a group of individuals can be determined. DNA testing has been shown to be as high as 99.99% accurate.

Colorado law provides that, in any action or proceeding where paternity is at issue, the court may, at the request of either party or on its own accord, require the child, mother and the man to submit to appropriate parentage tests including genetic (DNA) testing. A laboratory accredited by the secretary of the federal Department of Health and Human Services must conduct such testing.

In the past several years, DNA testing has become inexpensive and is usually considered by the courts as conclusive evidence. Due to advances in technology, DNA testing can now be completed within a few days and some laboratories will even make house calls to take samples. DNA samples were originally obtained by drawing blood samples. Although some laboratories still do this, most now obtain DNA samples by buccal swabs of the cheek cells in the mouth. Thus, testing for young children is much less invasive than it once was and DNA testing can be accomplished on anyone regardless of age.

If paternity is an issue in your case, it would be wise to request that genetic (DNA) testing be ordered by the court to conclusively determine the issue of paternity. In most cases, this will conclusively resolve the issue. The Court will then be free to move on to determine issues such as parental responsibilities, parenting time, and child support.

A second must read for fathers and alleged fathers about child support

Alleged father innocent?     - This article presented with the permission of Wendy McElroy - 08/25/04

Think you might be the father? read on

Today is my daughter's 18th birthday.......
I'm so glad that this is my last child support payment. Month
after
month, year after year, those payments!

So I called my daughter and asked her to come over to my house,
and when
she got there, I said to her, "Honey, I want you to take this last
check
over to your mother's house and tell her that this is the last
check
she's
ever going to get from me, and I want you to come back and  tell me
the
expression that's on her face."

So my daughter took the check over to her. I was really anxious to
hear
what she had to say and what she looked like.

As my daughter walked through the door, I said, "Now what did
she  have to
say?"

"She told me to tell you that you're not my daddy... and watch the
expression on your face".

Expand your knowledge about DNA Identification

DNA is the initialized short version for a genetic term known as DeoxyriboNucleicAcid.

By definition a nucleic acid that carries the genetic information in the cell and is capable of self-replication and synthesis of RNA.  DNA consists of two long chains of nucleotides twisted into a double helix and joined by hydrogen bonds between the complementary bases adenine and thymine or cytosine and guanine. The sequence of nucleotides determines individual hereditary characteristics.

Stated simply, each parent provides a set of 24 chromosome cells that carry the genes and function in the transmission of hereditary information to the offspring. The genes contained within the chromosomes are the building blocks of the offspring and are responsible for all inherited characteristics.  Each offspring or child has a unique DNA identity just as their parents. Therefore a highly probable identity of the mother, father, offspring and other genetic relationships of relatives can be mapped with an extreme degree of accuracy, about 99.9999%.  DNA tests are conducted for a number of reasons such as paternity or maternity, adoption, evidence for child support, for immigration records, forensics, infidelity, homo and hetero sexuality determination and others. DNA testing can give you the Peace of mind you deserve.

Collecting and submitting your DNA samples

The collection of DNA samples for testing is simple and painless.  If you are seeking DNA answers for your own personal information a buccal or a cheek sampling is fine which can be quickly taken in the privacy of your home or office by using the free kit that we provide and simply submit the sample to our DNA testing lab.  We provide Airborne Express envelopes for this purpose with all shipping prepaid to and from our test lab.  A cheek (Buccal) sample is the collection of saliva from both lower jaw cavities of the mouth on separate cotton swabs.  Should you require the samples for use in a legal matter you will need to make a brief visit to one of our convenient medical collection centers located near you. This will insure what the "chain of custody" as required by the courts will be maintained. The center collects the sample and therefore acts as an official, legal, witness as to the samples authenticity. A recent picture of each individual being tested must be provided with your sample submittal.  The testing center will normally take a quick Polaroid to accompany the sample (s) being submitted to the test lab for evaluation. The easiest way to get started is to call our office now at 1-866-889-3410 (toll free).

Benefits of Establishing Paternity

The establishment of paternity in unmarried births is seen as one way to address the

deprivations associated with out-of-wedlock parentage. Among the recognized medical benefits

to paternity establishment is knowledge about the father's genetic background, including potential

inherited disorders which allow appropriate medical care to be provided, and the possibility of

the father being the life-saving donor of bone-marrow, a kidney or other organs in a medical

emergency. The emotional and psychological benefits of paternity include the opportunity to

identify with the paternal half of a child's ancestral roots, and to know and explore family

heritage, culture and religious ties. Paternity may also lead to the opportunity to establish a

parent-child relationship and the exercise of paternal contact and access to the paternal family

Among the many social entitlements that ensue from paternity are the ability to realize

inheritance proceedings, survivor benefits through social security, and dependent benefits under

workman's compensation if the father is injured on the job. If the father is a member of the armed

forces, or becomes a member, paternity can lead to monthly dependent benefits, educational benefits and military health care and insurance.  Finally, paternity establishment may lead to important financial benefits. Evidence of paternity is needed if the mother wants child support. Evidence of paternity can also lead to dependent health care coverage if the father's employer has insurance and a share of unemployment compensation if the father is unemployed.

DNA and Infidelity Concerns

DNA Testing for possible infidelity usually requires the submission of articles of clothing, hairs with follicles attached, semen samples, blood, skin cells, saliva, lipstick, make up and many others. Should you discover a potential infidelity sample you wish to have evaluated be sure to retain the same in a paper container, e.g. bag or envelope to minimize contamination.  Please avoid the use of any plastic storage bags or containers. We suggest that you submit the sample or samples as soon as possible to protect the sample integrity for DNA evaluation. DNA is not only a very effective choice for paternity and forensic matters but quite conclusive for the establishment of spousal or partner activity related to infidelity.  The infidelity may occur as a part of any social relationship including a husband and wife, a girlfriend or boyfriend, and same sex relationships.  What should you consider as as an acceptable DNA sample for evaluation? After unprotected sex, sex without the use of a condom or diaphragm, all women experience a condition known as flow back.  This flow back typically causes a women to secrete small amounts of semen from the vagina for a period of up to 72 hours following intercourse.  During sexual activity, with or without intercourse, semen stains may also be deposited on various items such as sheets, towels, tissues, carpeting, upholstery and a list of many others.  Dried semen can remain on unwashed articles for many years and in most cases semen stains are easily recognizable giving the material in question a stiff, starchy, feeling and appearance.  These traces of dried semen are like glue and become locked into the fibers of the suspect article until the next time it is laundered.  Your wife or husband or any sexual partner may be bringing infidelity evidence home to you without even knowing it.  Other acceptable DNA evidence that may suggest infidelity includes hair samples ideally with the hair follicle in tact, skin cells, vaginal secretions, a glass with a suspect lip or fingerprint, stains on car seats or items of clothing and others. Evaluation of your submitted DNA samples will give you the answers and peace of mind you deserve.  If you wish you can remain anonymous by using an assumed or pen name as your identifier through the sampling and evaluation process.
